I. General Provisions

1. The data controller is Gigaly.co.uk (hereinafter: “Controller”).

II. Sources and Categories of Processed Personal Data

1. The Controller processes personal data that you have provided or data obtained in connection with fulfilling your order.
2. The Controller processes your identification and contact data and data necessary for fulfilling the contract.

III. Legal Basis and Purpose of Personal Data Processing

1. The legal basis for processing personal data is:

• the performance of the contract between you and the Controller,
• the Controller’s legitimate interest in providing direct marketing (in particular sending commercial communications and newsletters),
• your consent to processing for the purpose of direct marketing (commercial communications and newsletters) if no goods or services have been ordered.

2. The purposes of processing personal data are:

• to process your order and exercise rights and obligations arising from the contractual relationship; personal data (name, address, contact) are required to successfully process the order—without providing these data, the contract cannot be concluded or performed by the Controller,
• to send commercial communications and conduct other marketing activities.

3. The Controller may carry out automated decision-making or profiling; you provide your explicit consent for such processing.

IV. Data Retention Period

1. The Controller retains personal data:

• for the period necessary to exercise rights and obligations arising from the contractual relationship and to enforce claims under that relationship (15 years from the termination of the contractual relationship).

2. After the retention period expires, the Controller will delete the personal data.

V. Recipients of Personal Data (Sub-processors)

1. Recipients of personal data are entities:

• involved in delivering goods/services/payment processing under contract,
• providing the e-shop platform and related services,
• providing marketing services.

2. Some services used for marketing and support include:

• Google Ads – records cookies and site usage
• Facebook and associated platforms – records cookies and site usage

VI. Your Rights

1. In relation to processing your personal data, you have the following rights:

• the right to access your personal data,
• the right to rectification or restriction of processing,
• the right to erasure of personal data,
• the right to object to processing,
• the right to data portability, and
• the right to withdraw consent in writing or electronically using the Controller’s contact details provided herein.

2. You also have the right to lodge a complaint with the relevant data protection authority in your jurisdiction if you believe your personal data rights have been violated.

VII. Data Security Measures

1. The Controller declares that it has adopted appropriate technical and organisational measures to secure personal data.
2. Technical measures include secure/encrypted web access, encryption of customer passwords in the database, regular system updates and backups.
3. The Controller declares that personal data are accessed only by authorised personnel.

VIII. Final Provisions

1. By submitting an order via the online form, you confirm that you have read and fully accept these personal data protection terms.
2. The Controller is entitled to amend these terms. The new version will be published on its website and sent to your email address provided to the Controller.
